ProConsultants Pty Ltd ("ProConsultants", "we", "us") is the responsible party, as defined in POPIA, for personal information collected through this website (https://proconsultants.co.za) and through enquiries you send us.

When you contact us — through the contact form, by email or by phone — we collect the information you choose to give us:

• your name and, if you provide it, your company or organisation
• your contact details, such as email address and phone number
• the content of your message and any details about your project

When you visit the website, the servers that host it may automatically record standard technical information, such as your IP address, browser type, the pages requested and the date and time of the request. We do not use analytics, advertising or tracking tools on this website.

We use personal information only for the purposes it was collected for:

• to respond to your enquiry and communicate with you about it
• to prepare proposals and, if you engage us, to deliver and manage our services
• to keep proper records of our business communications
• to keep the website secure and working properly
• to comply with our legal and regulatory obligations

We do not sell your personal information, and we will not send you direct marketing unless you have agreed to receive it.

Under section 11 of POPIA we process personal information only where at least one of the following applies:

• you have consented, for example by sending us an enquiry
• it is necessary to take steps you have asked for before entering into a contract, or to perform a contract with you
• it protects our legitimate interests or yours, such as responding to enquiries and securing the website
• it is required to comply with the law

Where we rely on consent, you may withdraw it at any time. This does not affect processing that took place before you withdrew it.

We share personal information only where necessary, and only with:

• service providers (operators) who help us run the website and our communications — for example website hosting, email and form-processing services — who must keep the information confidential and secure, as POPIA requires
• our professional advisers, such as auditors and lawyers, where needed
• regulators, law-enforcement bodies or courts, where the law requires it

Some of our service providers may store or process information outside South Africa. Where this happens, we transfer it only as permitted by section 72 of POPIA — for example, where the recipient is subject to laws or binding agreements that provide an adequate level of protection.

We keep personal information only for as long as we need it for the purpose it was collected for. Enquiries that do not lead to work are deleted when they are no longer needed. Records relating to projects and contracts are kept for as long as the law requires, for example for tax and company-records purposes.

We take appropriate, reasonable technical and organisational measures to protect personal information against loss, damage, and unauthorised access or use, as required by section 19 of POPIA. If we have reasonable grounds to believe your personal information has been accessed or acquired by an unauthorised person, we will notify you and the Information Regulator as POPIA requires.

Under POPIA you have the right to:

• ask whether we hold personal information about you, and request access to it
• ask us to correct, update or delete your personal information
• object to the processing of your personal information, on reasonable grounds
• withdraw your consent where we rely on it
• not receive direct marketing without your consent
• lodge a complaint with the Information Regulator
